  • Compensation of Wage or Salary during Sick Leave as of January 1, 2014

    The several-year-long transitional period shall end by 31. 12. 2013. During this period, employees have been entitled to receive wage or salary compensation from the employer following the third working day of absence (or following twenty-four hours of absence from work in shifts) until the twenty-first day of absence due to sickness or quarantine. After the lapse of the 21-day period, the sick-leave compensation was paid from the sick-leave insurance.

    Previously valid rules shall apply again as of January 1, 2014, i.e. the employee will be entitled to receive compensation of wage or salary from the employer only for the first fourteen days of absence due to sickness or quarantine. As of the fifteenth day, the sick-leave compensation will be paid from the sick-leave insurance. The waiting period remains unchanged, i.e. there is no compensation for the first three work days of sickness (or twenty-four hours of absence when working in shifts).

    The above change shall be effective with respect to sick leave (or quarantine) which comes into being after January 1, 2014. If the employee falls sick or is ordered into quarantine before the end of 2013, the existing rules continue to apply (even if the sick leave ends after January 1, 2014).

    Given the fact that the provisions on sick leave (or quarantine) of the Labor Code are linked, to a certain extent, to provisions on termination of employment during the trial period, the latter are going to change as well. As of January 1, 2014, it will be again possible to terminate employment by the employer during the trial period after fourteen days of sick leave or quarantine on the part of the employee.
